Camera surveillance at ArtEZ

As part of the security measures to protect the students and members of staff, buildings and equipment, camera surveillance is employed in and around the ArtEZ buildings. Because images are recorded, that involves processing personal data. Integrity in the use of the camera system and the protection of personal data are very important. This page describes the purposes for which your personal data are collected, when and by whom the camera images may be inspected and how long the camera images are stored. Your rights are also described.

Purposes

Camera surveillance and the associated processing of personal data by means of cameras only take place for the following purposes:

  • Contributing to the protection of the safety and health of members of staff, students and guests in and around the ArtEZ buildings.

  • Securing the access to ArtEZ buildings.

  • Effectively securing the property of members of staff, students and the organisation against theft and vandalism.

  • Recording incidents.

Camera surveillance is not used to follow and/or monitor members of staff and students. As such, security cameras at ArtEZ are never aimed at or placed in:

  • work areas of members of staff;

  • toilets or toilet access areas;

  • changing rooms or changing room access areas;

  • teaching rooms.

Basis

The basis for camera surveillance in and around ArtEZ buildings is the justified interest of ArtEZ under article 6, paragraph 1(e) of the General Data Protection Regulation.

Types of personal data

The personal data which are processed are:

  • Video recordings of the people and things in and around ArtEZ buildings.
  • Data relating to the time, date and place at which the video recordings were made.

Recording images and retention period

  • The camera images are stored for a maximum of 28 days. After a maximum of 28 days, the recordings are automatically deleted.

  • If an incident is recorded on the camera images, such as a criminal act or an insurance matter, the images may be stored until the incident has been dealt with. Once it has been dealt with, the images will be deleted within 24 hours by the Facilities department.

  • The camera system is not and will not be linked to other personal data held by ArtEZ.

Inspection of images

  • Images may only be inspected retrospectively and stored for longer than the standard retention period of up to 28 days in the event of a request in relation to the purposes of camera surveillance referred to above. Requests that may be granted relate to:

    -       security of the locations;

    -       physical violence: including kicking, hitting, wounding, grabbing;

    -       psychological violence: including harassment, threats, stalking;

    -       sexual violence: including unwanted advances;

    -       vandalism and/or theft of property.

  • Requests to inspect the image material retrospectively should be submitted to the Facilities department. Requests will only be granted if the requester is able to provide the location, date and time of the incident and the reason for inspection.

  • Image material will be inspected and assessed by the member of staff of the Facilities department. By default, the requester and any other persons involved will not be given access to the images.

  • Other individuals can obtain permission to view camera images on an incidental basis, under the responsibility and with the permission of the head of Facilities, on the condition that the person in question has a compelling, justified interest and that the privacy of those involved will not be unlawfully compromised.

  • Images will not be provided to third parties unless the following conditions are met:

    -       It is necessary for reasons of:

    •       national security;

    •       public safety;

    •       prevention, investigation, detection and prosecution of criminal acts or for the execution of sentences, including protection against and prevention of risks to public safety.

    -       A demand to this effect has been made by the police, the public prosecutor or another special investigation agency on a lawful basis.

Your rights

As with other processing of personal data by ArtEZ, you have various rights which you can exercise with regard to camera surveillance:

  • Right of inspection
  • Right of rectification and erasure
  • Right of objection
  • Right to restriction
